SALES TERMS GENERAL

Terms and sale conditions regulate products sold by VINERIASANGIACOMO, through the website www.vineriasangiacomo.it. All purchase contracts of finished products, through this website, are according to procedures indicated, between the seller and the customer, will take advantage by these sale conditions (according to Italian law Legislative Decree 70/2003 in relation to e-commerce and Legislative decree 206/2005 focusing regulations regarding long distance contracts). Changes or new sale terms will be promptly reported to the Customer, it will be effective from the moment it's published on the site and applied only to sales concluded after publication.

ACCEPTANCE OF SALES TERMS AND CONDITIONS

The contract dealed by Vinerisangiacomo.it and the Customer shall be concluded by Vineria San Giacomo acceptance of order. The acceptance is implied, if not communicated by any means to the Customer. Placing a purchase order as conformed, the Customer declares having read the instruction provided during the purchase process and also agrees to the terms described. We invite you to read carefully the sale terms and print or save the information.

PURCHASING METHODS

The Customer may only purchase products on the site https://www.vineriasangiacomo.it/ by placing the order as described in the factsheets. Manufactures provide to support products with information. Vineria San Giacomo therefore, reserves the right to change the informations of products adapted and provided by manufactures. The images on the site are provided for customers to vision the products, the photos may not reflect exactly the delivered product. The correct order of Vineria San Giacomo is confermed with an e-mail to the address provided by the customer. The conferming message will contain date and hour of the reciept of order and a "Order Code", to use in all the communications with Vineria San Giacomo, as a reference for sale conditions. In case of non acceptance of order, Vineria San Giacomo will send an imediate notification to the Customer. The prices on the website are retail prices vat included. Vineria San Giacomo reserves the right to modify prices without prior notice (according to tax increases of the manufacturing companies) retail prices don't include any taxes, duties, charges or services that differs from Italy. Vary costs from country to country is loaded by the customer, that can verify the amount with the competent customs authorities. With a specific written request, we will refund the amount incurred.

PAYMENT METHOD

The customer may purchase the products on the website Vineriasangiacomo using several forms of payment as indicated in the purchase process. Any additional amount to a specific payment method will explicityly be highlighted during the purchase process

DELIVERY

Vineria San Giacomo delivers it's products by specialist carriers. Expedition costs, are borne by the customers and are highlighted at the time of order placement. Depending on goods destination, deliveries may be done within a period ranging from 24 hours to 4 days, barring setbacks. On recieving the goods the customer is obliged to check its integrity, and if there are doubts it must be noted on the dleivery receipt. The customer shall have 14 days to verify the integrity or damage of goods and provide to send a writen notice via e-mail to info@vineriasangiacomo.it. info@vineriasangiacomo.it Within 2 weeks Vineria San Giacomo will refund the customer.

RIGHT OF WITHDRAWAL

The Customer is entitled to cancel the contract without any explanation, within 14 days. The withdrawal shall expire after 14 days from the date the customer is in possession of the goods.

To exercise the right of withdrawal, the customer is obliged to inform Vineria San Giacomoof the decision with an explicit declaration (via postal letter, fax or e-mail) info@vineriasangiacomo.it. This FORM OF WITHDRAWAL can be used but is not mandatory.

To respect the deadline of withdrawal, it's sufficient that the client sends a communication concerning the exercise of the right of withdrawal before the withdrawal expiry. If the customer withdraws from this contract, he will be refunded for all payments performed to Vineria San Giacomo including cash on delivery (except for additional amounts arising from the personal choice of a different least expensive, standard delivery), without indue delay and not later than 14 days from the Vineria San Giacomo is informed fo the customer's decision. Refunds will be effected by the same payment method used by the customer in the initial transaction, unless the customer has proceeded; how ever there will not incur any costs consequence of this refund. The refund can be suspended until reciept of the goods or until the customer confirms the goods have been returned. The customer has to refund the goods and deliver them to vineriasangiacomo, without undue delay and within 14 days from the comunicated termin of the contract. The deadline is met if the customer refunds the goods before the expirations of 14 days, the amount of refunding goods will be borne by the customer. The customer is responsible fot the dimished value of the goods resulting from improper hadling, compromising the typical charateristic taste or effect. Damaged or used products even if only partially won't be refunded. The right of withdrawal will not be applied to sealed goods, personalized with special sizes, or by their nature are liable to deteriorate rapidly, or have been unwrapped after delivery sealed goods are not refunded for hygiene reasons, related to health protection.

WARRANTY

The cusotomer buying as a consumer has the right of warranty on the products and purchased services conditions within 24 months established by the law, as long as defects are communicated to Vineria San Giacomo, using the same conditions of withdrawal, within the 2 months it has been checked.

PRIVACY

The personal information requested under the order are achieved by Vineria San Giacomo and processed on media technology, in order to meet the obligations arising from the contract concluded with the customer, and will not under any circumstances or for any reason be passed to third parties. Vineria San Giacomo provides its customer with respect and legislation regardig the processing of personal data covered by the privacy code legislative decree N. 196 del 30.06.03. The data controller is DE PIERO MICHELE, Via Cesare Battisti 29, 33084 Cordenons (Pordenone), the person who has legal representetion, unless a supervisor is approved according to the law art.29 of legislative decreee n. 196/2003. The customer, at any moment, has the right to withdraw concert to the processing of personal data by written notice sent to Vineria San Giacomo, at the address above. The customer according with Art. 7 of D.Lgs. n. 196/2003 has the right to access the data behalf concieve. Marketing communications are sent only by explicit consent issued by the customer reviewed with the authorization to process and sending in the registration form online.

PROTECTION OF MINORS

Vineria San Giacomo does not sell wine or other alcoholic products to persons under the age of 18 years. The carrier will not deliver wine or other alcoholic products to persons under the age of 18 years or based on different legislation, and may require and identify document for age verification.

COMPLAINTS

IN CASE OF DISPUTES

These general conditions are governed by italian law as well as each sales contract and subject to italian jurisdiction. Any dispute relating to the terms and conditions to sales will be competent court of residence or domicile of the purchaser
